  6. Catalog Course Description

    Federal, state, and local laws are studied as they relate to the preservation of historic structures. Special attention is given to the role of historic architecture review boards, as well as planning commissions in the decision making process.

  7. Required Course Content and Direction

    1. Learning Goals:

      1. The understand the history and development of historic preservation law
      2. To interpret Federal, State and Local historic preservation law.
      3. To discuss State laws authorizing historic preservation and derivation of State Authority
      4. To provide an overview of historic preservation litigation process

      1. History and development of historic preservation law
      2. Discussion of court cases recognizing the power of restrictions and the relationship between zoning laws and historic preservation law in the courts
      3. Overview of historic preservation regulatory process
      4. Interrelationship among Federal, State and Local historic preservation law
      5. Requirements of a local preservation ordinance
      6. A model ordinance
      7. Sate laws authorizing historic preservation and derivation of State authority
      8. State historic register, certification and preservation programs
      9. Federal laws dealing with historic preservation and Federal Programs Section 106
      10. Constitutional issues, due process and the first amendment
      11. Overview of the historic preservation litigation process
      12. Tax laws and incentives
